AMENDMENT AND RATIFICATION OF RESTRICTIONS FOR HICKORY HILLS SUBDIVISION, SECTION 1

WHEREAS, Restrictions dated January 9, 1987 relating to Hickory Hills Subdivision, Section 1, were filed of record on January 9 , 1987, and are recorded in Volume 1108, Pages 181 through 188 of the Deed Records of Van Zandt County, Texas; and

WHEREAS, the original plat of said Section 1 which is recorded in Glide No. 195A of the Plat Records of Van Zandt County, Texas, has been amended only in the particular that the boundary field notes now "tie into" the northwest corner of the D. Spencer Survey, Abstract No. 824 and

WHEREAS, the Amended plat of Hickory Hills, Section 1 is recorded in Glide No. 199B Plat Records of Van Zandt County, Texas; and

WHEREAS, the undersigned, Projects American Corporation, owner of all of the land in said Section 1, desires to make certain that the Restrictions as filed will refer to the Amended Plat and will accordingly apply to, the lots and blocks depicted therein,

NOW THEREFORE KNOW ALL MEN BY THESE PRESENTS that Projects American Corporation does hereby ratify and confirm the said Restrictions relating to Hickory Hills, Section 1 and declare that they shall apply to Hickory Hills, Section 1 as amended and further that the Restrictions be amended to show the recording of the Amended Plat so that the beginning paragraph of the Restrictions will read as follows:

"THAT, PROJECTS AMERICAN CORPORATION, a Texas corporation, acting herein by and through its duly authorized officers, hereinafter called "Developer", owner of all of that certain tract of land out of the D. Spencer Survey, Abstract No. 824, Van Zandt County, Texas, as shown on subdivision Plat entitled Hickory Hills Subdivision, Section 1, recorded in Glide No. 195A as Amended and Recorded in Glide No. 199E of the Plat Records of Van Zandt County, Texas, do hereby impress all of the property included in such subdivision with the following restrictions:"

BEFORE ME, the undersigned authority, on this day personally appeared JIM C. RAWSON, President of PROJECTS AMERICAN CORPORATION, known to me to be the person and officer whose name is subscribed to, the foregoing instrument and acknowledged to me that the same was the act of the said PROJECTS AMERICAN CORPORATION, a corporation, and that he executed the same as the act of such corporation for the purposes and consideration therein expressed, and in the capacity therein stated.
